Sri Lanka government to establish special anti-corruption courts targeting Political opponents

The Sirisena-Wickremasinghe government of Sri Lanka is rushing to push through a law that will establish a special criminal courts system to function outside the regular court system in order to target political opponents. The government whip minister Gayantha Karunathilaka presented the bill, as an amendment to the Judicature Act, to the Parliament on March 05.

The system of Courts called Permanent High Courts at Bar, branded by the ruling United National Party chiefs as Anti-Corruption High Courts will have powers to hear the cases selectively filed in the form of direct indictment by the Attorney General and the Director General for the Prevention of Bribary and Corruption(DGPBC). The judges are nominated by the Judicial Service Commission and the Minister  can decide the number and place  of the Courts. Under the normal procedure it is the Chief Justice who can appoint a trial-at-bar to hear gruesome cases of murder and rape, while the proposed law will institute permanent trial-at-bar courts and vest the power of initiating cases on the executive and administrative authorities.

The scheduled offences triable by these Courts include almost all financial and public property related offences including bribary and corruption and money laundering. The courts must hear the cases on day-to-day basis and conclude expeditiously.
The bill as a whole is unconstitutional and anti-democratic.  The sole discretion of instituting action in these Courts against arbitrarily selected suspects is placed on the Attorney General and the DGPBC without any oversight either by way of a magisterial inquiry or by the Commission to Investigate Bribery or Corruption respectively, contrary to the regular procedure. It usurps the right of an accused for a fair trial and impinges upon independence of the judiciary.

The bill is exemplary of the practice of successive governments of Sri Lanka notoriously exploiting its courts and the legal system to suppress working class struggles and intimidate political opponents.

Backed by United States to change the regime of former president Mahinda Rajapakshe in order to distance the island from the influence of China to suit US geo-strategic demands within the region,  the Sirisena-Wickremasinghe government was installed in January 2015, claiming to fight against corruption and establish good governance. Since then, the government has been targeting Rajapakshes and members of his Joint Opposition for various allegations of corruption, though this campaign subsided in the backdrop of the revelations of  of the bond scam directly implicating chiefs of the ruling United National Party(UNP).

In August last year, in response to several ministers blaming government during  Parliament sessions for failing to take actions against the frauds and corruption of the Rajapakshe government, Ministers Rajitha Senarathna, Patali Champika Ranawaka, Mangala Samaraweera and Sarath Fonseka called to setup a separate court to hear the cases of corruption and frauds during the last government. The ministers were aware of the rapid growth of public discontent about the government which could keep to none of the election promises, while Rajapakshe faction was to benefit from the aggravating circumstances. The revival of the anti-corruption campaign was to divert the public dissatisfaction against the government.

President Sirisena hypocritically blamed, also in August last year, that his government has "failed to put an end to corruption and waste". In January, after the report on the Central Bank bond scam was released and addressing a local government election rally, he declared he would ensure that the corrupt politicians from whatever party would be sent to prison and then to hell before he quit office.  He tweeted "my term ends the day corrupt politicians, murderers and thieves are brought to justice.”

Malik Smarawickrama, UNP Chairman and Development Strategies and International Trade Minister told media in January, " the UNP is putting an end to the days of rampant corruption under the previous regime that robbed people of their future" and that it is " strengthening [our] courts and forcing through reforms that will enable us to properly prosecute those under the previous government that stand guilty of corruption".

The bill was brought under severe circumstances of economic instability, growing class tensions and massive financial scandals. Between 2019 and 2022 the government has to pay US $ 3.6 billion annually as debt-repayments. The cash-strapped government has been compelled to implement more austerity measures dictated by the International Monetary Fund (IMF) in order to receive financial assistance and face militant struggles against budget cuts, tax-hikes and for pay increases by the working class, youth and the rural poor.

The coalition went to further political crisis in the aftermath of the local government elections  in early February, which exposed widespread opposition to the ruling parties. The newly-formed Sri Lanka Podujana Peramuna (SLPP), led by Rajapakse, could win control of the majority of local councils, on the basis of widespread public dissatisfaction over government's austerity measures and pro-imperialist policies. Amidst the crisis of the coalition after the election results, the US and Indian government stepped into "advise" that the ruling parties continued the coalition, which led to a sham cabinet reshuffle.

Seven years after the lifting of emergency rule in Sri Lanka, in early March,  Sirisena declared State of Emergency on the backdrop of the anti-Muslim violence carried out by a Sinhala-Buddhist racist mob in the central Kandy district, fomented by the Sri Lankan ruling class to divert the growing working-class opposition to its austerity program. The government capitalized the racist provocations to ban social media for a week. Last week,  Wickremasinghe unveiled the government's plan to introduce laws to regulate freedom of speech over the internet.

Since January, the Joint Opposition led by Rajapakshe was gathering support for a no-confidence motion against Wickremasinghe, on the basis of his alleged involvement in the bond scam, which was handed over to the speaker of the parliament last week(21st).

Countering the fragility of the ruling government requires that its political opponents are suppressed at any cost. While Rajapakshe and his associates will be prime target in view of the general election to come, these new laws will be employed against any political faction to compel continued support for the coalition.

Several members of the Joint Opposition proceeded to the Supreme Courts challenging the bill. The Rajapakshe and his faction has no concern whatsoever of the democratic rights and living standards of the broad masses. Instead, they are worried about the growing threats against their survival and deprivation of their privileges. Once coming into power,  they will also use these laws to suppress any political opposition in turn.

The anti-corruption crusade is the slogan of many oppressive regimes all over the world,  including those of Cyril Ramaphosa of South Africa, Xi  Jingping  of China to Rodrigo Duterte of Phillipine. They exploit rampant corruption, which is endemic in the capitalist nation state system, to sideline political opposition and to divert working class fighting against social counter- revolution, leading to anti-democratic and authoritarian rule.

වර්ගවාදයට එරෙහිව පන්ති විඤ්ඤාණය

රටේ විවිධ ප්‍රදේශවල මුස්ලිම් පීඩිත මහජනතාවට එරෙහිව එල්ල කරනලද වාර්ගික ම්ලේඡ ප්‍රහාර සියලු කම්කරු පීඩිත මහජනතාව පිලිකුලින් යුතුව හෙලා දැකිය යුතුය.  සිංහල වර්ගවාදී නඩ විසින් මෙහෙයවන ලද මෙම ප්‍රහාර සෑම අනුප්‍රාප්තික ධනපති   රජයක්  සේම  අර්බුද ග්‍රස්ත  සිරිසේන-වික්‍රමසිංහ  ආන්ඩුව විසින් ඉවසා සිටියා පමනක් නොව එයට අනුබල දෙමින් වාර්ගික රේඛා මත සිංහල මුස්ලිම් කම්කරු පීඩිත මහ ජනතාව විරසක කොට බෙදා දැක්වීම සදහා කටයුතු කරනු ලැබීය.  ආන්ඩුව වැඩට බැස ඇත්තේ ප්‍රජාතන්ත්‍ර විරෝධී හදිසි නීතිය ක්‍රියාත්ම්ක කරමින්,  සමාජ මාධ්‍ය ජාලා අවහිර කරමින් හා මිලිටරි හා පොලිස් මර්දනය දිගේලි කරමිනි. 

මෙම තත්ත්වය යටතේ සිංහල මහ ජනතාව වර්ගවාදයට ගොස් ඇතැයි ගෙන යන ප්‍රදාන ධාරාවේ මාධ්‍ය හා සමාජ ජාල ප්‍රචාර එහි හරයෙන්ම වඳය. වර්ගවාදය මහ ජනතාව මත සැමවිටම පිටතින් පටවන්නකි. ඔවුන් එදිනෙදා අත්විදින කටුක ජීවන අත් දැකීම් වලට විසදුම් නොදෙන ආන්ඩු ඔවුන් මත කප්පාදු වැඩපිලිවෙල ක්‍රියාවට දැමීමත් සමග ධනවාදී අර්බුද සමයේදී සැබෑ සමාජවාදී විකල්ප දේශපාලන ඉදිරිදර්ශනයක් වහංගුකල රික්තකය තුල වර්ගවාදී විශබීජ යහමින් පෝශනය කර උත්සන්න කෙරේ.

සෑම රටකම වර්ගවාදීන් ධනවාදයේ අතිශය අර්බුද සමයන්හි වර්ගවාදය න්‍යායගත කිරිමට හා  වගා කිරීමට ඇතිතරම් කරුනු ඉදුරිපත් කරනු ඇත. ඒ සෑම කරුනකම පොදු සාදකය ලෙස තම වර්ගයාගේ අනන්‍යතාවය ට  හා එයට ඇති වරප්‍රසාදවලට එරෙහිව ඇති ඊනියා තර්ජනයක් මතු කෙරේ. බොහෝ විට එකී කරුනු ඉතිහාසය මුසාකරනයට ලක් කිරීමෙන් ව්‍යුත්පන්න කරනු ලැබේ. කෙසේ නමුත් මෙම ව්‍යාපාරවල අවසන් ප්‍රතිඵලය වන්නේ  වෛරී වාර්ගික ප්‍රචන්ඩත්වය තවත් ජන කොට්ටාශයකට එරෙහිව  මුදා හැරීමයි. 

වර්ගවාදීන්ගේ ඒ හෝ මේ න්‍යායික හා  ඓතිහාසික තර්ක සමග පැටලීම සහමුලින්ම නිරර්තකය. ධනවාදී ජාතික රාජ්‍ය පද්ධතිය තුල වර්ගවාදය අත්‍යවශ්‍ය අංගයකි.  ඔනෑම වර්ගවාදයකට එරෙහි  සැබෑ දේශපාලන ඉදිරිදර්ශනයක් පදනම් විය යුත්තේ වර්ගවාදය පදනම් කෙරෙන හා මිනිස් සංහතිය වාර්ගික රේඛා හරහා බෙදා දැක්වීම මත පදනම් වන බංකොලොත් ධනපති ක්‍රමයටම එරෙහිව කරන ක්‍රම විරෝදී අරගලයක් මතය. 

ධනවාදයේ අර්බුද සමය යනු එක් අතකින් වර්ගවාදය, ජාතිකවාදය, ආරක්ශනවාදය, ජාතික සංශෝදනවාදය ඇතුලු  සියලු ආකාරයේ ප්‍රතිගාමීත්වයන් වර්ධනය කරන අවදියක් වන අතරම, අනික් පසින් එය පන්ති අරගලයේ උච්චතම අවදියක් ද වේ. 

විවිධාකාරයේ විඤ්ඤාණවාදී මිත්‍යාවන්ට   එරෙහිව  ඓතිහාසික සත්‍ය සදහාත් ජාත්‍යන්තරවාදය සඳහාත් භෞතිකවාදීව මහජනතාව උගන්වා ගනිමින් කම්කරු පීඩිත මහ ජනතාව එක් කරනු ලබන තම පන්ති විඤ්ඤාණය සඳාහා සටන් කිරීම එකී  ක්‍රමවිරෝදී හා වර්ගවාදයට එරෙහි අරගලයේ අත්‍යවශ්‍ය කොන්දේසිය වේ.

අනුරාධපුර රාජධානිය ක්‍රි.පූ.377 ත් ක්‍රි.ව. 1017 අතර පැවති බවට සාධක තිබේ. පන්ඩුකාභය, දේවනම්පිය තිස්ස, දුටුගැමුනු, මහාසේන, වලගම්බා, දාතුසෙන, සීගිරි කාශ්‍යප එම පරිච්ඡේදයේ ප්‍රධාන  රජුන් වූ බවට සදහන්ය. මෙම කාලයේ සිටම ලංකාවට විදෙස් රටවල් සමග වෙලද සබඳතා මෙන්ම රාජ තාන්ත්‍රික සබදතාද පුලුල්ව පැවතිබවට පර්යේෂන වාර්තා සනාථ කරයි. 

මූලිකවම, ලංකාව කෘෂිකාර්මික ආර්ථිකයක් වර්ධනය කිරීමට පෙර සිටම ජාත්‍යන්තර වෙලදාම හරහා ලංකාව වෙලඳ රාජ්‍යයක්  ලෙස වැජඹෙනි.  මේ හේතුවෙන්ම  ලංකාව එකල ඉහල මට්ටමේ විදේශ සම්බන්දතා පැවත්වූ රාජ්‍යයක් ව පැවතිනි.  පැරනි යුරෝපය, ඉන්දියානු කලාපය හා චීනය සමග ද ලංකාව ප්‍රබල වෙලඳ හා රාජ තාන්ත්‍රික සබඳතා පැවත්විය. එනම් එය කිසිසේත්ම අන්ධකාරයේ පැවති හුදකලා රාජ්‍යක් නොවිනි. 

ලංකාවේ පුරාන වෙලදාම 

කෘෂිකර්මය අතින් ස්වයංපෝශිත  කාල වලදී වත් ලංකාව කිසිවිටක සහල් අපනයනය නොකලේය. මිනි, මුතු සහ ඇත්තු ද පසු ව කුරුදු ද අනුරාධපුර යුගයේ සිට ප්‍රධාන අපනයන භාන්ඩ විය. රජුගේ අනසක යටතේ එනම් රාජ්‍ය අනුග්‍රහය හා අධීක්ශනය යටතේ සිදුකෙරුනු ජත්‍යන්තර වෙලදාම රටට විදේශ විනිමය ගෙනා ආ අතර  ප්‍රධාන වශයෙන්  එම ආදායම වැවු අමුනු හා ගොඩනැගිලි නිර්මානයට යෙදවිනි. දේශීයව එකතු කල බදු හරහා සීමිත  සුහ සාදන සේවවන් ද නඩත්තු කෙරිනි.  රට තුල නගර හා ගම් වශයෙන් බෙදුනු කලාප පැවති අතර නගර හා ගම් අතර වෙලදාම සිදු විනි. ගම්මාන කිසිවිටක සර්ව ස්වයංපෝශිත වූයේ නැත.

කමලිකා පීරිස් හා සුදර්ශන් සෙනෙවිරත්න ලියන පරිදි ප්‍රාග් ඓතිහාසික යුගයේ සිටමත්, විශේෂයෙන් ක්‍රි.පු.900 සිට ක්‍රි.පූ.400 දක්වා කාලයේදීත් ලංකාවේ කදුරට මැනික් හා පාශාන, ලබා ගැනීම සඳහා උතුරු ඉන්දියාවෙන් වෙලදුන් ලංකාවට පැමින ඇත. ලංකාවේ මුලු භූමියම තනි රටක් ලෙස පාලනය වීමට පටන් ගත් අවස්ථාව වීමටත් ප්‍රථම මෙම වෙලඳ ගනු දෙනු සිදුවී තිබේ. වානිජ යන වචනය ලංකාවේ විවිධ ප්‍රදේශවලින් හමු වූ ශිලා ලිපිවල සොයා ගෙන ඇත. මේ සමහරක් ක්‍රි.පූ.1 හා 2 ශතවර්ෂ වලට අයත්‍ වේ. ක්‍රි.පූ.2 ශත වර්ශයේදී රටේ දකුනේ ගොඩවාය යන නාවික තොටුපොලින් භාන්ඩ ඇෆ්ගනිස්තානයට යැවුනි. 

අනුරාධපුර යුගයේදී රටේ සෑම කලාපයකම වානිජ ගනු දෙනු සිදු විනි. කොලඹ, බලපිටිය, දෙබරවැව හා මාතර ඇතුලු කලාප කිහිපයකින්ම් රෝම කාසි එක් ස්ථානයකින් දහසකට වැඩ් ප්‍රමානයක් බැගින් හමුවී තිබේ. එනම් රටේ විවිධ ස්ථානවල විදේශ සංචිත තිබී ඇත. 

මින් ඇඟවුම් කෙරෙන දේ බොහෝය. ඉන් ප්‍රදානම වන්නේ නාවික ගමනා ගමනය සම්බන්ද එකල ලංකාවේ මිනුසුන්ටද අනෙක්  වෙලද රටවල් වලට මෙන්ම පහසුකම් හා අදාල නාවික තාක්ෂණය  තිබුනු බවයි. උතුරු ඉනදියාව යනු නිරන්තර මධ්‍යදරනී ගොඩබිම් කලාපය හා යුරොපය සමග සබදතා පැවත්වූ ශිෂ්ටාචාරය කි. එ අනුව පැහදිලිවම උතුරු ඉන්දියානු දැනුම ලංකාවට සංක්‍රමනය වීමට අවශ්‍ය තරම් ඉඩ ප්‍රස්ථා විවරව පැවතුනු බවට නිගමනය කල හැක. 

ක්‍රි.ව.976 සිට 1265 කාලයට අයත් සෑම චීන අධිරාජ්‍යයෙකුගේම කාසි අනුරාධපුරය , පොලොන්නරුව , දැඩිගම, යාපහුව, කුරුනෑගල ආදී  ස්ථාන වලින් හමු වී තිබේ. 3 හා 4 වන ශතවර්ෂ වලට අයත් කලා ඔය, වලවේ ගඟ, දැදුරු ඔය හා කැලණි ගඟ ආශ්‍රිත වෙලඳ නගර තිබුනු බවට සාක්ෂි හමුවී තිබේ. 

ක්‍රි.පූ.4 වන සියවස සිට ක්‍රි.ව. 4 වන සියවස දක්වා නැගෙනහිර -බටහිර වෙලඳාමේ කේන්ද්‍රස්ථානය වූයේ ඉන්දියාවයි. ඉන්දියානු වරාය වලදී ලාංකික වෙලදුන් ග්‍රීක හා රෝම වෙලඳුන්ට තම භාන්ඩ විකුනා දැම්මෝය. 5 වන ශතවර්ෂයේදී ලංකාව නැගෙනහිර-බටහිර වෙලඳ මාර්ග වල සන්ධිස්ථානයක් බවට පත් විනි. ලංකා වරාය වලදී පර්සියා, චීන, ඉතියෝපියානු, ඉන්දියානු වෙලදුන් බඩු හුවමාරු කර ගන්නා ලදී.

ජාත්‍යන්තර මූල්‍ය අරමුදල ලංකාවේ ආන්ඩුවට කප්පාදු වැඩපිලිවෙල කඩිනම් කරන ලෙස අවධාරනය කරයි

ජාත්‍යන්තර මූල්‍ය අරමුදල (ජාමූඅ) 2018 වසර තුල හා ඉන් ඔබ්බට ශ්‍රී ලංකාව විසින් ක්‍රියාවට දැමිය යුතු කප්පාදු වැඩපිලිවෙල කැටිකර දක්වන කාර්ය සාධන වාර්තාවක් නිකුත්කර ඇත.

2016 ජුනි මාසයේ සිට ලංකාව පවතින්නේ ජාමූඅ විසින් විස්තාරනය කරන ලද අරමුදලින් ඇපයට නය දීමේදී පොරොන්දුවූ වැඩපිලිවෙල යටතේ බව එම වාර්තාව යලි මතක් කර දෙයි. මුල්‍ය හිඟයකින් පෙලෙන ජනාධිපති මෛත්‍රීපාල සිරිසේනගේ හා අගමැති රනිල් වික‍්‍රමසිංහගේ ආන්ඩුව ගෙවුම් ශේෂ හිඟය මධ්‍යයේ ජාමූඅ වෙතින් ඩොලර් බිලියන 1.5ක නය මුදලක් ලබාගත් තතු තුල ශ්‍රීලංකාව සිටින්නේ ජාමූඅහි දැඩි අධීක්ෂනයක් යටතේ ය.
ශ්‍රී ලංකාව මත පනවා ඇති කොන්දේසි, යුරෝපා ස්ථාවරත්ව යාන්ත‍්‍රනය යටතේ ජාමූඅ, යුරෝපා කොමිසම හා යුරෝපා මහ බැංකුව යන “ත්‍රිත්වය” විසින් ග්‍රීසිය හා ස්පාඤ්ඤය මත පනවන ලද කොන්දේසි සිහියට නංවයි.
ජාමූඅ විසින් ශ්‍රී ලංකාව මත පනවන කොන්දේසි, වැඩකරන ජනයාගෙන් බදු මිරිකා ගනිමින් ආන්ඩුවේ වියදම් කැපීමකට ගැටගසනු ලැබ තිබේ. 2015 දී දල දේශීය නිෂ්පාදිතයෙන් (දදේනි) සියයට 7.2ක් වූ අයවැය පරතරය 2020 වනවිට සියයට 3.5ක් දක්වා අඩු කිරීම පිනිස දැවැන්ත ලෙස ආන්ඩුවේ වියදම් කප්පාදුවක් සිදු කිරීම මෙයට ඇතුලත් ය.
මූල්‍ය තත්ත්වය ශක්තිමත් කිරීම -එනම් අයවැය පරතරය කැපීම-, ආදායම් රැස්කර ගැනීම -එනම් බදු ඉහල දැමීම හා ආදායම් සමුච්ඡය කරගැනීම අඩංගු කප්පාදු “වැඩපිලිවෙල යටතේ වන ක්‍රියාකාරීත්වය බොහෝ සෙයින් නිවැරදි මාවතේ පවතින” බව ජනවාරි 12දා නිකුත් කල ජාමූඅ වාර්තාව සඳහන් කරයි. එහෙත් ”ප‍්‍රතිසංස්කරන ගාමකය අඛන්ඩ ව පවත්වා ගැනීමේ අභියෝගය” තව දුරටත් පවත්නා බව එම වාර්තාව කියා සිටී. “ආර්ථිකය කම්පනයන්ට ගොදුරු වීමේ අන්තරායකාරී කාලයක සිටියදීම, 2018 වසරේ පටන් ආන්ඩුව අධික නය ආපසු ගෙවීමක අභියෝගයට ද මුහුන දී සිටින” බව එය කීවේ ය.
රජයට අයත් ව්‍යවසායයන් පුද්ගලීකරනය කිරීමේ පවතින මන්දගාමීත්වය හා ආදායම් පරතය අඩු කිරීමේ අවශ්‍යතාව ගැන වාර්තාව සිය උත්සුකය පල කර ඇත. සිය වැඩපිලිවෙලට බලපාන අනෙක් අංශය ලෙස ජාමූඅ සඳහන් කර ඇත්තේ “2020 ජාතික මැතිවරනය වනවිට සභාග ආන්ඩුවේ දේශපාලන එකමුතුකම වික්‍රිය විය හැකිවීම” යි.
ජාමූඅට පවතින උත්සුකයන් වනාහි අන් කිසිවක් නොව පුද්ගලීකරනය, කම්කරුවන් හා දුගීන්ගේ සුභසාධන සහනාධාර කප්පාදුව හා බදු ඉහල දැමීම වහවහාම ක්‍රියාවට දමාගැනීමයි.
ආන්ඩුව ශ්‍රී ලංකන් එයාලයින් ගුවන් සේවය විකුනා දැමීම සඳහා පුද්ගලික ගැනුම්කරුවෙකු සොයමින් සිටී. ලංකා බැංකුව හා මහජන බැංකුව යන රාජ්‍ය බැංකු දෙක කොලඹ කොටස් වෙලඳපොලේ ලැයිස්තු කරන බවත් ඒවායේ වගකීමෙන් ආන්ඩුව නිදහස් වීම අපේක්ෂා කරන බවත් 2018 අයවැය කතාවේ දී මුදල් ඇමති මංගල සමරවීර නිවේදනය කලේ ය. ආන්ඩුව සූදානම් කරන ප‍්‍රහාරය ගැන බැංකු දෙකෙහි සේවය කරන 40,000කට ආසන්න සේවකයන් අතර කැලඹිල්ලක් වර්ධනය වෙමින් තිබේ.
ලංකා විදුලිබල මන්ඩලය, ලංකා ඛනිජ තෙල් නීතිගත සංස්ථාව, ගුවන් තොටුපොල හා ගුවන් සේවා දෙපාර්තමේන්තුව, ජාතික ජල සම්පාදන හා ජලාපවාහන මන්ඩලය සහ ශ්‍රී ලංකා වරාය අධිකාරිය වැනි සියලු ම ප‍්‍රධාන පෙලේ රාජ්‍ය ව්‍යවසායයන් දැනට මත් වානිජකරන “සංගත අභිප‍්‍රායන්” සඳහා ලැයිස්තුගත කරනු ලැබ තිබේ. ආන්ඩුවේ මූල්‍ය සම්පාදනය මත රඳා නො පවතින ලෙස ඒවාට උපදෙස් ලබා දී ඇත. මෙම සංස්ථාවන්හි ඒකාබද්ධ පාඩුව රුපියල් බිලියන 52ක් බව වාර්තාව සඳහන් කලේ ය.
වානිජකරනය යටතේ මෙම ආයතන විසින් සම්පාදනය කරන විදුලිබලය, ජලය, තැපැල්, දුම්රිය හා අනෙකුත් සේවාවන්වල ගාස්තු තියුනු ලෙස ඉහල දැමීමක් ජාමූඅ බලාපොරොත්තු වේ. “...2018 මාර්තු වනවිට ඉන්ධන ද සැප්තැම්බර් වනවිට විදුලිබලය ද සඳහා ස්වයංක්‍රීයව මිල තීන්දු වන යාන්ත‍්‍රනයක් කැබිනට් මන්ඩලය විසින් අනුමත කරනු ඇති” බව ජාමූඅ විමර්ශනය කීවේ ය. යෝජනා කරනු ලබන්නේ මිලගනන් දාම ප‍්‍රතික්‍රියාවක් ලෙස ඉහල යාමට හේතුවන පරිදි ඉන්ධන හා විදුලිබලය සඳහා අයකරන ගාස්තු වැඩිකිරීම යි.
මෙම කප්පාදු පියවරයන් රැකියා, සේවා හා ජීවන කොන්දේසි මත බලපාමින් ආර්ථික වර්ධනය පහල දැමීමට ද තුඩුදී තිබේ.
හිටපු ජනාධිපති මහින්ද රාජපක්ෂ දෙමල ඊලම් විමුක්ති කොටි සංවිධානයට එරෙහි ව දෙමල විරෝධී යුද්ධය ගෙනයමින් හා මර්දන පියවරයන් යොදාගනිමින් 2006 සිට වැටුප් කැටිකිරීමක් පවත්වාගෙන ගියේ ය. රාජපක්ෂ තන්ත‍්‍රය 2009 පටන් ජාමූඅ විසින් නියෝග කරන ලද කප්පාදු පියවරයන් ද පැටවීය. 2015 මුල ජනාධිපති සිරිසේන බලයට පැමිනි පසු කම්කරුවන් හා දුගීන් අතර කෝපය අපසරනය කිරීම සඳහා සීමිත වැටුප් වැඩිකිරීම් හා මතුපිට වෙනස්කම් කිහිපයක් ආන්ඩුව විසින් සිදුකලේ ය.
එහෙත් අත්‍යවශ්‍ය භාන්ඩවල මිල ඉහල යාම නිසා දුගීන්ගේ ජීවන කොන්දේසි ඛාදනයවී ඇත. 2017 දෙසැම්බරය වනවිට, 2016 දෙසැම්බරයේ සියයට 4.2ක් වූ වාර්ෂික උද්ධමන අනුපාතය සියයට 7.3ක් දක්වා ඉහල ගියේ ය. එම මාසයේ ම, කලින් වසරේ තිබූ සියයට 2.3ට සාපේක්ෂව, ආහාර ද්‍රව්‍යවල මිල උද්ධමනය දැවැන්තව සියයට 12.8ක මට්ටමකට නැග්ගේ ය.
ජීවන තත්වයන් මෙලෙස ඛාදනය වීම තුඩු දී ඇත්තේ සෞඛ්‍ය, දුම්රිය, තැපැල්, ඛනිජ තෙල්, විදුලි සංදේශ හා විදුලිබල සහ වතුකම්කරුවන් ඇතුලු කම්කරු පන්තියේ සෑම කොටසක් අතර ම වැඩි වැටුප් ඉල්ලමින් විරෝධතා නැගී ඒමටයි. මෙම අරගල මැඩීමට පොලීසිය හා සන්නද්ධ හමුදාවන් මුදා හරින ආන්ඩුව කම්කරුවන්ගේ ඉල්ලීම් යටපත් කිරීම සඳහා වෘත්තීය සමිති නායකයන් පාවිච්චි කලේ ය. සුභසාධන සේවා ඉල්ලන ගම්බද දුගීන්ගේ අරගල දෛනික දෙයක් බවට පත්වී තිබේ.
2017 තුන්වන කාර්තුවේ රටෙහි දදේනියේ වර්ධනය සියයට 3.3ක් විය. 2017 වර්ෂය සඳහා සමස්ත වර්ධන අනුපාතය කලින් පැවති සියයට 5 සිට සියයට 4.2 තෙක් පහල යනු ඇතැයි තක්සේරු කෙරේ.
ප‍්‍රතිපත්ති අධ්‍යයන ආයතනයේ ප‍්‍රධානී දුෂ්නි වීරකෝන් “ස්ථාවරත්වය පැවතුනත් ශ්‍රී ලංකාව දම්වැලෙන් බැඳී සිටියි” යන මාතෘකාවකින් ලියූ ලිපියක් තුල, ජාමූඅ කප්පාදු කොන්දේසි ආර්ථික වර්ධනයට සංකෝචනාත්මකව බලපාන ආකාරය අවධානයට ලක්කලා ය. කර්කශ කාලගුනයට අමතර ව “වර්ධනය පහල යාමට හේතු වන අනෙක් කාරනය වන්නේ ජාමූඅ වැඩපිලිවෙල යටතේ සංකෝචනාත්මක මූල්‍ය ස්ථාවරත්වය ඇති කිරීමේ ප‍්‍රයත්නයන්ය”. පරිභෝජනය හා නිෂ්පාදනය මත ඉහල බදු පැනවීම වියදම් කලහැකි ගෘහීය ආදායම් හා සංගත ලාභ යන දෙක ම සීමාකල බව ඇය සඳහන් කලා ය.
අනෙක් රටවල මෙන් මෙහි දී ද “ආර්ථික ප‍්‍රකෘතිය” සඳහා වන ජාමූඅ බෙහෙත් වට්ටෝරුව ව්‍යාජයකි. යථාර්ථයේ දී එය, කම්කරුවන්ගෙන් හා දුගීන්ගෙන් හැකිතාක් මිරිකාගෙන ජාත්‍යන්තර බැංකුකරුවන් හා මූල්‍ය ආයෝජකයන් ඇතලු ධනවතුන් වෙත ධනය මාරු කරන ක්‍රියාමාර්ගයකි.
ස්ථාවරත්වය ගැන ආන්ඩුවේ පුච්චානම් කෙසේ වෙතත්, “රාජ්‍ය නය ඉහල මට්ටමක පවතින තතු තුල [ආර්ථික වර්ධනය] පහලයාමේ අවදානම සෑහෙන ඉහල මට්ටමක පවතී” යයි ජාමුඅ විමර්ශනය සඳහන් කරයි. මේ වසර සඳහා සමස්ත නය ආපසු ගෙවීම ඩොලර් බිලියන 2.9ක් වනු ඇති බව තක්සේරු කෙරෙන අතර ලබන වසර සඳහා එය ඩොලර් බිලියන 4.2ක් වන්නේ ගිය වසරේ අගය වූ ඩොලර් බිලියන 2.2 මෙන් දෙගුනයකට ලං වෙමිනි. 2020 සිට 2022 දක්වා නය ආපසු ගෙවීම ඩොලර් බිලියන 3.6ක් යයි තක්සේරු කෙරේ.
එවැනි විශාල නය ගෙවීමක් සඳහා කම්කරුවන් හා දුගීන්ගේ ජීවන හා සමාජ අයිතීන් මත ප‍්‍රහාර උත්සන්න කිරීම හැර ආන්ඩුවට අන් මාවතක් නැත.
සමාජ පිපිරීමේ කැකෑරෙනසුලු ස්වභාවය ගැන දන්නා ජනාධිපති සිරිසේන, ඔහු ද මුලුමනින් වගකිව යුතු ආන්ඩුවේ ක්‍රියාමාර්ගවලින් ඈත්ව සිටින බව පෙන්වීමට වියරු ලෙස උත්සාහ කරයි. පසුගිය සති අන්තයේ පැවති පලාත් පාලන මැතිවරන රැලියක දී සිරිසේන මෙසේ කීවේ ය: “පසුගිය අවුරුදු තුනේ දී මම (සභාගයේ ප‍්‍රධාන සහකරු වන එක්සත් ජාතික පක්) එජාපයට ආර්ථිකය කලමනාකරනය කරන්නට ඉඩ දුන්නා. ඒත් තවමත් ජනතාව ආර්ථික දුෂ්කරතාවන්ට මුහුන දී සිටිනවා.” මෙතැන් පටන් “ජනතාවට සහන සැලසීම සඳහා” ආර්ථිකය තමන්ගේ පාලනය යටතට ගන්නා බව ඔහු කීවේ ය.
ජනතාවට “සහන” සැලසීම යන්න අමු කෙප්පයකි. ආර්ථික අර්බුදය අරගල සඳහා වේදිකාව සකසද්දී ආන්ඩුව සූදානම් කරමින් සිටින්නේ පොලිස් රාජ්‍යයක වැඩපිලිවලයි.

IMF reviews Sri Lanka's  austerity measures amidst government's claim of economic stability

Early January, the International Monetary Fund(IMF) published its third review (staff report) of the three year Extended Arrangement under the Extended Fund Facility(EFF), which sets out its austerity demands upon which it released US$ 251.4,  the fourth tranche of the bailout money to Sri Lanka in last December. 

The EFF was approved by IMF in June 2016 to enable Sri Lanka to resolve the island nation's balance of payment crises on the strict conditions that the US backed government of  Prime Minister Ranil Wickremasinghe and President Sirisena implements economic reforms aimed at fiscal tightening, restructuring state owned enterprises(SOEs), privatization and reforming its revenue laws. 

"A return to fiscal consolidation, targeting a reduction in the overall fiscal deficit to 3.5 percent of Gross Domestic Product(GDP) by 2020, is the linchpin of the reform programme", and "Rebuilding tax revenues through a comprehensive reform of both tax policy and administration will be key in this regard, supplemented by steps toward more effective control over expenditures and putting state enterprise operations on a more commercial footing", the IMF June 2016 press release said. 

The conditionalities imposed on Sri Lanka largely resembled those imposed on Greece and Spain by the Troika, which include IMF, Europen Commission and European Central Bank, under the European Stability Mechanism(ESM). 

The third review reveals that the government's economic reforms have placed fiscal consolidation, revenue mobilization, monetary policy management and reserves accumulation broadly on track. The government's 2016 VAT law amendments increased VAT rates and narrowed exemptions. The lender insists on implementation of the program’s landmark reform, the new Inland Revenue Act,  which was legislated in October 2017, by  April 2018.  "Consistent with the objectives of the EFF-supported program, the authorities announced a new far reaching economic plan titled Vision 2025 in September 2017," the review says.

Government passed the Budget 2018 in last December strictly in line with these demands of
IMF, which the report stated targeted a primary surplus of 1 percent of GDP and fiscal consolidation towards the objective of reducing the overall fiscal deficit to 3.5 percent of GDP by 2020. "Vision 2025: A Country Enriched" is the government's austerity programme aimed at achieving these demands during the next eight years.
Early this month, presenting the Road Map for 2018, the monetary and financial sector policies for 2018 and beyond, Central Bank Governor,  Indrajit Coomarsawamy, exposed government's devout adherence to IMF demands. He stated, "the government is also committed to a revenue based fiscal consolidation programme, which intends to bring down budget deficits and debt levels progressively."

The island is deep-trodden in an escalating debt crisis. The total debt repayment for the next three years would be 7,000 billion rupees ($45 billion). Fiscal consolidation requires government to reduce the budget deficit to 4.5 percent in 2018, which stood at 5.4 percent last year.  The government is bound to honour IMF's neoliberal policies in order to meet these debt repayment goals and reduce budget deficit. 

The review was released while the government and the Central Bank desperately claimed of reaching economic stability by the end of 2017, in view of the Local Government elections in next month. In his new year message to the people at the dawn of the year,  Wickremasinghe said "amidst great challenges, we were able to steer forward in restoring economic stability and a process of sustainable development."

In his speech presenting the Road Map, Coomarsawamy echoed Wickremasinghe and stated,  "macroeconomic stability is being restored and our economy is trending in the right direction," which he had said, in end of December, has won the investor confidence. 

Yet, even the official indicators do not hide the gloomy picture. Country's GDP growth stood just at 3.3 percent in the third quarter of 2017. In spite of country's exports expanding by 8.2 percent in the first nine months of year 2017, imports increased by 9.7 percent expanding the trade deficit to US$ 6.8 billion, an increase of US$ 0.7 billion from year 2016. Foreign reserves of a meagre US$ 7.3 billion comprises mainly of borrowed monies and bond sales. The government will incur large amortization payments in 2018, and  will be burdened with repayments on its international sovereign bonds starting in 2019. Gross financing needs (amortization payments plus overall deficit) are projected to reach 20 percent of GDP in 2018, IMF staff report details.

In spite of government's claims of stability, the review states, "Sri Lanka remains vulnerable to shocks given its high level of public debt, large financing needs, and weak external position." Therefore, the lender recommends that, "fiscal consolidation should continue, supported by effective tax administration and spending controls." In respect of monetary policy, it advocates the central bank maintain "a tightening bias to contain inflation and credit growth pressures, while continuing to accumulate reserves accompanied by greater exchange rate flexibility." Reforms in SOEs, "especially in the areas of energy pricing and airline restructuring, should proceed without further delay".

In fact,  the  claims of so called "stability" is nothing about any gains for the working people and the poor, but an indication of the ruling establishment's sighs of relief in implementing  austerity measures at the expense of the working class and the poor, and satisfying the demands of foreign investment and of IMF to receive balance bailout funds. 

The Institute of Policy Studies, a think-tank based in Colombo, consoled the ruling elite and top businesses in its September last year report stating, "with the gains made in fiscal consolidation so far under the IMF's watchful eye, achieving and retaining macroeconomic stability appears more probable."

What the working class and the poor in turn have got is welfare cuts, increased taxes and consumer price hikes, unemployment, reduction of wages, privatization,  state repression of militant strikes against these measures and subjection to police state apparatus. 

Inflation in the country stood at 7.1 percent in December while food inflation rose to 14.4 percent. Youth unemployment stands at 18.30 percent.

In October last year, the government deployed  police and brutally attacked workers who protested against the long term lease of down South, Hambantota Port to a Chinese company. 435 workers lost jobs subsequent to the deal. President Sirisena declared fuel distribution an essential service in July last year and declared same on railways in December to counter and force break worker strikes. Last week, the government used police anti-riot squad and attacked protesting Electricity Board workers.  This is how the Wickremasinghe-Sirisena government met the "great challenges".

Sri Lanka Government implements Vision 2025, the austerity programme for the next eight years.  



Sri Lanka government is devoutly implementing "Vision 2025: A Country Enriched", the government's economic and  austerity programme for the next eight years,  lunched by President Maithripala Sirisena and Prime Minister  Ranil Wickremasinghe, in early last September.

Presenting the monetary and financial sector policies for 2018 and beyond, Sri Lanka Central Bank Governor, Indrajith Coomaraswamy on Wednesday declared the Bank's proposed moves to keep up with government's "Vision 2025", which he said "unveils the future policy direction of the country".

End of December last year, while disclosing the last monetary policy review for the year 2017 he also endeavoured to show that the country's economic stability is reached and would remain so, given the current fiscal consolidation is continued. Early December, Coomaraswamy told the Financial Sector Investment Conference that the Bank is confident in being able to handle the sovereign debt repayments in next two years, "provided the fiscal consolidation measures stays on track".  

The Government passed its Budget for 2018 in early December, which is primarily grounded on the policies of Vision 2025. This so called economic vision to "make Sri Lanka a rich country by 2025" is the programme recommended by the World Bank aimed at fiscal consolidation, opening Sri Lanka's resources and labour for international capital and streamlining privatization. 

The whole claim of a vision for a "country enriched" is falsehood. In the backdrop of staggering social polarization, poverty and unemployment which have exacerbated after 2008 economic and financial crisis that hit the United States and has had spiralling effects all over the world almost over a decade, this implies the building of a country for the super rich. The budget for 2018 ensures this, in that the indirect taxes paid chiefly by the working people will constitute a 74 percent of the government’s total tax income, while direct taxes paid by the rich will fall to just 17 percent. 

Aimed at furthering fiscal consolidation in order to reduce debt-to-GDP ratio by 70%, which currently stands at 79.30% of GDP, the agenda is also a consolidation of the neoliberal policy demands of International Monetary Fund(IMF). Wickremasinghe declared at the launch that, in order to do so, the Unity government has "formulated a forward-looking liability management strategy for domestic and foreign debt under the medium term debt management strategy", and that "the country hopes to repay all its outstanding loans by 2025". So, the whole programme is primarily a debt repayment mechanism. 

Wickremasinghe also declared government's moves to further liberalize Sri Lankan market to attract foreign direct investment(FDI), by stating that it has formulated a new trade policy, along with an original "National Export Strategy", aimed at creating a "more liberal, simple, transparent and predictable trade regime".

Some of the significant economic policy goals in the Vision 2025 include the following:

• Strengthening the macroeconomic framework, which has three prongs: fiscal consolidation, ensuring price stability, and maintaining a market-based competitive exchange rate and "prudent" monetary policy. The policy statement plainly exposes that "external debt repayments from 2018 requires strong fiscal consolidation measures for debt sustainability and growth".


• Transforming Sri Lanka into the economic hub of the Indian Ocean, with a export-oriented, highly competitive, social-market economy: It promises citizens "higher incomes" and "better standards of living".


• Enhancing global competitiveness of the economy. This implies further trade liberalization.


• Introducing business-friendly legal reforms. Finance Minister Mangala Samaraweera said archaic laws such as the Agricultural Lands Act and Shop and Office Employees Act would be amended to provide more market flexibility.


• Rationalizing public expenditure and restructuring State Owned Enterproses (SOEs) as commercially viable enterprises.


• Encouraging Public-Private Partnerships (PPPs): the potential areas would include health care, leisure, tourism, education, ports and aviation. This mechanism is intended to release the government of welfare burden and increasingly privatizing essential services.

Sri Lanka is mired in a acute debt crisis, the budget deficit standing at 5.4% of GDP. The GDP for 2017 and for this year is estimated at 1999 billion rupees ($ 13 billion) and 2,326 billion rupees ($US15 billion), respectively, the increase pointing to the tax hikes following the recent drastic tax reforms and 2018 budget, while the total debt repayment for the next three years would be 7,000 billion rupees ($45 billion), as stated by Samaraweera.

Early December last year, granting $ 251.4 million as the fourth tranche of the agreed bailout loan of $1.5 billion, the IMF forced its conditionalities onto the government: continuous fiscal consolidation, building up foreign reserves, maintaining a liberal exchange rate regime, tightening monetary policy and restructuring SOEs. Fiscal consolidation requires government to reduce the budget deficit to 4.5% by 2018 and to 3.5 % by 2020.


It is in this background that the government is forced to cut social welfare, increase taxes and liberalize trade and labour, like many European Union countries including Greece, Ireland,  Italy, Portugal and Spain, to reduce budget deficits and sovereign debt. The promises of prosperity and development for the masses is therefore a blatant lie. 

During last eight months up to end of November, the government cut funding for the limited social welfare programmes of Samurdhi by 700 million rupees ($ 4.5 million) and the fertilizer subsidy by 3.8 billion rupees ($ 24.8 million), compared to the same period last year. 

In a good gesture for foreign direct investment (FDI), government approved early in December a 32 year period of income tax holiday for the  China Merchants Port Holdings company, to which the government leased Southern port of Hambabtota for 99 years, amidst much concern by US, India and Japan. Wickremasinghe stated that the money out of this deal would be used for debt repayment.  The government is also aiming at privatising Sri Lankan Airlines, the national carrier, on claims of being loss-incurring SOE under a PPP, as also demanded by IMF.

The budget for 2018 was passed with more than two third majority in Parliament in favour, showing the readiness of the whole bourgeoisie establishment to impose severe austerity measures on larger public. Samaraweera declared at a post-budget forum that "the main theme of the budget, 'enterprise Sri Lanka' and liberalizations are non-negotiable. "Non-negotiable" means that the policies are not subject to any compromise with the opposition of the working people. 

The Wickremasinghe-led United National Party (UNP) and Sirisena-led Sri Lanka Freedom Party(SLFP) entered into a unity government in 2015 to drive through its pro-market policies and suppress the already-emerging opposition of the working class against social counter-revolution. 

Wickremasinghe has a long history of implementing pro-market reforms. In November 2015, he presented an economic policy statement outlining sweeping pro-market reforms that would drastically affect jobs, wages and living conditions of workers and the poor, while offering benefits and concessions for foreign and local businesses. Even before, in 2002, his previous government got approval from the World Bank and IMF for a parallel agenda of economic policies laid down in the Poverty Reduction Strategy Paper(PRSP), which was consolidated in the programme of "Regaining Sri Lanka". Succeeding governments of Chandrika Kumaratunga and Mahinda Rajapakshe continued the same. 

The working class should reject these agendas. Under a workers’ and peasants’ government founded on socialist policies sovereign debt would be repudiated. The mass opposition to the implementation of these policies should be guided by a political perspective for socialist restructuring of the economy nationally and globally against international capital.

The Marxist approach to the Jathika Chinthana "Lie"

Is it necessary for Marxists to debate with nationalists, for instance neo-Nazis and others, including followers of Nalin de Silva? In so far as their propositions challenge Marxist materialist theory, Marxists have to deal with them. But once it is covered within the basic dichotomy  between idealism and materialism, Marxists do not need to proceed further in attacking such idealist popositions. However, we can deal with their subjective ideologies that deny objective truths even in the political and social life of a society. Quantum mechanics is about physical micro world and not about social life of a national and international society which is a macro-level social organization. One may also call it the relative frame of reality upon which Marxists work.

Sinhala nationalists deny objective truth and at the same time assert a whole history, knowledge of a Sinhalese race and a united Sinhala Country from the so called King Dutugemunu, whose existence in the past they assert as an objective truth. This is a serious contradiction of the so called Jathika Chinthana, and there are many. Simply, once they deny objective truth, they have no right even to utter a word, because then words have only relative meaning and therefore there is no word, no language, no communication, everything is private and depends on the Observer, the I; So no cultural heritage and no social organization is possible. Then they would argue that there is a relative truth agreeable for common purpose and social organization. But that yet again is relative to observer. The history of a nation underlies the histories of classes. For example the history of the Sinhalese is the history of the elites and not of the oppressed claases in feudal and monarchical systems. The history of different casts under so called Sinhala kings would have been different to the meta-narrative of Ruling elites. There would have been casts who did not want to identify themselves with so called Sinhalese of the elites. They would have asserted their culture was the true Sinhala culture. So what is Sinhala too is problematic and depends on evidence and relative to different clases in feudal systems, arguing in line with denial of objective truths. They also say the knowledge we have been educated with is western.

The Jathika Chinthana flows from idealist formulations of Nalin de Silva, whose so called Constructive Relativism(CR) is an anti-marxist metanarrative, asserting primacy of mind above matter,  that no objective world can be perceived without mind. But it fails to assert that the mind can exist without matter, or to answer whether the mind which is also a creation of mind itself exists in a vacum, free from laws of time and space. There cannot be mind without relationship to external matter, even to create most primary concepts, images from which to create othet concepts and images without additional external information. Mind thus itself exists in relationship to matter.   Mind is history, images, past, conditioning, thoughts, which all arise in association with matter (matter is not necessarily mass, but includes magnetic fields, all forms of physical energy etc and our sensory images). There is no mind without thoughts, consciousness which are all obtained through senses. Mind is impotent to create itself without matter, images. Mind simply cannot perceive the change,movement or change in itself being unrelated to external movement, changes in matter. The primacy of Mind and matter is not a question of egg before hen. It's through mind that objective material world is perceived, but the assertion of the existence of Mind independant of matter cannot deny  the existence of Matter independent of Mind.

Constructive Relativism has one unique way of disassociating with  the western philosophy's argument against idealism: to assert that the idea of mind in CR is not the same as that which is identified in western philosopy's idealism: that so called Sinhala Theravada  Chinthana formulation of mind is different from the concept of mind in what is referred to as  Weastern Greek Judaic Christian Chinthanaya as against Catholic Thinking. Marxists do not have to bother with such disasscosition, because it in no way affects its political programme.

The objective truth for Marxists is that there is a market, a capitalist system, there is imperialism, Sinhala nationalism, Tamil nationalism, an international working class,  and so on. Marxists do not bother whether such truths are relative to the Observer. History is read by Marxists with dialectical method. Historical materialism is the method of interpreting the written history .

Why do the West impose their hegamony  of knowledge? The purpose is political and economic. Imperialism is one such expression. Their economic hegamony is founded on global capitalism.

There is hardly any merit in having a debate with Jathika Chinthana. There is no purpose in debating with religious fanatics too. The simple question Marxists must put to the working class, the workers and youth who belong to different  identities is, how to resolve the crisis of global inequality, poverty and social misery, which are objective  realities, also perceived by mind through the senses. The programme to defeat identity politics needs to assert the fight against Capitalism.

Marxists examine the objective economic, political and historical foundations of a phenomenon, an incident, a development. Instead of analysing the histories of a nationality, Marxists analyse the history of nationalism being used as a bourgeoisie weapon of class division.

Nalin de Silva's theory on mind and knowlede being fundamentally idealist, Marxists should plainly deny any impact on Marxist programme for Socialism and against Capitalism. The basic line of division between Marxism and Constructive Relativism is the line dividing  materialism and idealism.

කැටලන් පාර්ලිමෙන්තුව ඔක්තොම්බර් 27 එකපාර්ශිකව ස්පාඤ්ඤයෙන් වෙන්වීම  එනම්   නිදහස ප්‍රකාශ  කලේය.ඒ සදහා කැටලන් ආන්ඩුවට එහි ජනතාවගෙන්  ඔක්තෝම්බර් 1 දා ජනමත  විචාරනයෙන් ඉහල ජන වරමක් ලැබුණි.  පාර්ලිමේන්තු අධිරාජ්‍යය ක් වන ස්පාඤ්ඤය  1978 ආන්ඩුක්‍රම   ව්‍යවස්ථාවේ  2 වන වගන්තිය අනුව විසිරුවාහල නොහැකි ඒකකයකි. එය සෑම ස්පාඤ්ඤ වැසියකුගේම පොදු හා විභේදනය කල නොහැකි මවුබිමයි. එය සියලු ජාතීන්ගේ ස්වයං  පාලනය සදහා ඇති අයිතිය පිලිගන්නා අතර එය තහවරු කරයි:
"The Constitution is based on the indissoluble unity of the Spanish Nation, the common and indivisible homeland of all Spaniards; it recognises and guarantees the right to self government of the nationalities and regions of which it is composed and the solidarity among them"

ස්පාඤ්ඤ   ව්‍යවස්ථා අධිකරණය  ජනමත විචාරනය නීති විරෝධී යැයි තින්දු කලේය. ස්පාඤ්ඤ ආන්ඩුව ඡන්දය නතර කිරීම් සදහා මිලිටරි පොලීසිය යොදවා මර්ධනය දිගේලි කලේය. දැන් ස්පාඤ්ඤ  ආන්ඩුව විසින් කැටලන් පාර්ලිමෙන්තුව විසුරුවා හැර සෘජු පාලනයට යටත් කොට ඇති (155 වගන්තිය)  අතර නව මැතිවරනයක් කැදවා ඇත. කැටලන් පොලීසිය විසුරුවා ඇත. අවසාන  අදියරෙදී මෙම තත්ත්වය කැරල්ලක් හා දරුනු මර්දනයක් හෝ සිවිල් යුද්දයක් වෙත තල්ලුවීම නොවැලැක්විය හැකි ය.

මෙයින් සනාථ වන එක් පැහැදිලි සත්‍යයක්  තිබේ- කිසිදු   ඒක පාර්ශවික වෙන්වීමක් සාමකාමීව සිදු නොවේ. අවසානයේ  ආන්ඩුක්‍රම   ව්‍යවස්ථාව හෝ නීතිය කුමක්ද යන්න තීරනාත්මක සාධකය   නොවේ. විසදුම තීරණය  වන්නේ දේශපාලන තලයේදී ය. එය ප්‍රාන්ත ආන්ඩුවල මිලිටරි බලය, එයට ඇති ජනතා සහාය හා මධ්‍යම රජයේ මිලිටරි  බලයෙන් මෙන්ම අදිරජ්‍යවාදී මදිහත්වීම් මගින් අවසානය සනිටුහන් කරයි.

ප්‍රාන්යක් මධ්‍යම රාජ්යයෙන් වෙන්වීම තීන්දු කිරීමත් සමග  රටක ඒකීයභාවය පිලිබඳව එහි   ආන්ඩුක්‍රම   ව්‍යවස්ථාවේ කුමක් සදහන්  වුවත් ඒ මොහොතේ සිට තවදුරටත්  එම  ව්‍යවස්ථාව ක්‍රියාත්මක වීම නතර වේ. ඉන් පසු කාරනා තීරනය වන්නේ දේශපාලනය හා මිලිටරි බලය මතයි.

එ අනුව ව්යවස්ථා සම්පාදක අවස්ථාවකදී රටක ව්යවස්ථාවේ "ඒකීය"  හෝ " සංදීය " යන්න සඳහන් කිරිම තීරනාත්මක කාරනා   නොවේ. එවන් සාකච්චාවක් මග එලිකරනු ඇත්තේ දෙපැත්තේම ජාතිවාදය ශක්තිමත් කිරීම වෙතයි. එමගින් අන්ත දක්ශිනාන්ශික ජාතිවාදී පක්ශ ඊලඟ මැතිවරනයේදී බලය තහවරු කර ගැනීමට උදවු වනු ඇත.

ව්‍යවස්ථා  සම්පාදනයේ දී වඩාත් වැදගත් වනු ඇත්තේ ප්‍රාන්ත ප්‍රදෙශ වලට විමධ්‍යගත  කරන පරිපාලන බලතල සම්බන්ද කාරනාය. විශේෂයෙන්  පොලිස්, මිලිටරි, විදෙශ කටයුතු යන කාරනා විමධ්‍යගත  කිරීම ප්‍රාන්තයක්  වෙන්වයාම තීරනය කිරීම සමග එනම් ව්යවස්ථාව අකර්මණ්‍ය  විම ආරම්භ  වන විට අතිශය තීරනාත්මක කරුනු බවට පත් වේ.

කෙසේ නමුත් වෙන්වයන ප්‍රාන්යක් අවසාන වශයෙන් පිහිටවනු ඇත්තේ තවත් ධනපති ආන්ඩුවක් බැවින් එහි සාමාන්‍ය  වැඩකරන ජනතාව ඇතුලු පීඩිත පන්තීන්ට ලැබෙන සහනයක් නම් නැත. ලෝක සමාජවාදී වෙබ් අඩවිය පැහැදිලිව දක්වන පරිදිම ස්පාඤ්ඤ මහජනතාව මධ්‍යම  හා  ප්‍රාන්ත  ආන්ඩු මගින් එක දිගට 2008 මූල්‍ය හා ආර්ථික අර්බුදයෙන් පසු ක්‍රියාවට දැමූ කප්පාදු වැඩපිලිවෙල මගින් බැටකනු ලැබිණි.  ඒ හේතුවෙන් එම ආන්ඩු    මහජන අප්‍රසාදයට පත්ව ඇති  තතු තුල කැටලන් ධනපති ආන්ඩුව එම අප්‍රසාදය   ගසා කෑවේ ජාතිවාදී බෙදුම්වාදය ඉස්සරහට දමා ගනිමිනි.

දකුනේ ආන්ඩු බලය තහවරු කිරීම සදහා  සිංහල ස්වෝත්තමවාදී ආන්ඩු යටතේ දියත් කල අකටයුතුකම්, මර්ධන හා සමූල ඝාතන වලට අමතරව ලංකාවේ  දෙමල ධනපති ජාතිවාදී දෙශපාලනය මූලිකවම පදනම් වන්නේද  මෙවැනිම තතු යටතේය.

TWAIL - Why it is an empty shell?

A two day workshop on Third World Approaches to Internatinoal Law held in University of Colombo concluded today. Further to my initial reading of TWAIL literature, the workshop provided space to see how its main proponents approached to the different opinions expressed.

Confirming my presumptinos on TWAIL project before the workshop, the workshop only solidified my initial thoughts about it. While what I note here is partly some first thoughts, they lack only detailed annotation here and in summary the conclusiooins I have arrived at are valid to the core. 
 
Firstly, TWAIL is limited fundamentally by nationalism and regionalism and, as its two proponents, Prof.Anghie and Prof.Vasuki,  admitted at the workshop, TWAIL has multiple approaches and therefore it has no basis of a meta-nararative and no grand theory to be laid as the foundation of its discourse.  Thus it is almost possible that anybody representing so called third world interests to speak about Third World within TWAIL, ironically without having studied any literature in TWAIL: one would be a TWAIL-er even without knowing what TWAIL is, because there is nothing theoretical in it. This goes in line with postmodern rejection of meta-narratives  and highlighting of multiple identities and theories. 

Secondly, while TWAIL claims to represent the interests of the people of the third world against the Third World state, it also protects it and stands by it for its sovereignty. This is a fundamental contradiction. If it represents the interests of the peoples, then independance from all affiliations from the ruling classes has to be established.  You cannot have it and not have it at the same time, and to meet the end of upholding rights of the oppressed masses, a different approach would have to be found. 

Thirdly, while its natinoalist limitation is inherent and it theoretically poor in its content  TWAIL fails to answer the question of the global inequality, austerity and consequences of  financial crisis in the first world, in spite of the TWAIL's claims to have  imancipatory goals.  It fails to answer the issue of global drive for war  by the major imperialist powers.

To argue that first world is also becoming another third world due to financial crises is an absurd argument, which is fundamentally contradictory to the basic premises of TWAIL itself. If that argument is accepted, a series of fundamental questions have to be raised: then what is the dominant faction/oppressor that vield power on the newly formed third world?  Is it so called Transnational Capitalist Class(TCC) that dominates over the Transnational Oppressed Class (TOC),  to use prf.Chimni's terminoloby? Then what is the validity of the concept of imperialism or neo-colonialism in respect of those newly formed third world in the developed world? What is meant by global justice then, justice to whom and against whom? Why are there all of a sudden these concepts of TCC  and TOC which were not used to explain the Third World in the Third World at the first instance? Then what would be the result if these purported new concept tools applied to the Third World? Then how does our first understanding of the causes and consequences of the injustice caused to the Third World changes or is there no change at all? 

This phenomenon cannot be explained by any other means but employing the theory of surplus value and the collapse of rate of profit in the global capitalist system. It is only Marxist School of law that is capable of explaining this phenomenon. Globalization of production, rise of financial capital, collapse of rate of profit, financial crises, bail outs, austerity, inter imperialist tensions and drive for global hegemony and global war, the Capitalist system rooted in the nation-state system, and  resistance by the international working class are the issues to be discussed in order to understand this whole phenomenon. Laws are made to legitimize polarisation of wealth(62 richest persons have more wealth than  what half of the poorest of the world population has in total),  financial paracitism and grave environmental damage(Federal Court ruled that mitigated and nominal damages, just $9.5 billion,  be paid by British Petrolium in respect of the worst ever environmental disaster in US history and worst ecological disaster in the world in Deepwater Horizen Oil spill in Mexico Bay in 2010)drive for global hegemony,  mass spending for nueclear war heads (US to spend 1 Trillion dollars in the next thirty years), to legalise austerity and cracked down upon civil and political rights of those who resist, to intensify surveilance, the wars abroad and police state apparatus at home. Therefore laws are at the service of the market and the  capitalist classes around the world. While domestic,  municipal laws are so framed, Internatinal law is also necessarily to be employed to meet this end. 

Only the Marxist School of law can adequately answer these issues and explain the injustice caused to the Third World by colonialism and imperialism.

Economy of Sri Lanka as a concern of National Security


The recent determination of the Supreme Court of Sri Lanka in respect of the Constitutionality of the Right to Information Bill (RIB) raises several salient issues for serious consideration. While the Bill itself is intended for nothing other than to further place systematic limitations on the right to information provided under the 19th Amendment to the Constitution, which would have to be dealt with in another paper, this comment tries to highlight a significant development in the judicial interpretation of the exceptions cum limitations to the fundamental rights guaranteed by the Constitution.

In its unanimous determination the three Bench panel of judges has held several clauses of the RIB unconstitutional, while some others are not. The Court has determined that Clause 5(1)(c)(v) is ‘not inconsistent with any of the provisions of the Constitution’, on the basis of its interpretation of the exception given in Clause 5(1)(c), declaring that ‘a restriction of information that would cause serious prejudice to the economy of Sri Lanka is justified as part and parcel of protecting the rights of others and the economy of Sri Lanka.’  The Court justifies the inclusion of ‘a restriction against the disclosure of information that would cause serious prejudice to the economy of Sri Lanka’ as part and parcel of the interests of “national security”. This paper briefs the political-economic foundations of this interpretation and its wider implications.

Clause 5(1)c of RIB provides that access to information shall be refused where :

(c)  the disclosure of such information would cause serious prejudice to the economy of Sri Lanka by disclosing prematurely decisions to change or continue government economic or financial policies relating to:-

(i) exchange rates or the control of overseas exchange transactions;
(ii) the regulation of banking or credit;
(iii) taxation;
(iv) the stability, control and adjustment of prices of goods and services, rents and other costs and rates of wages, salaries and other income; or
(v) the entering into of overseas trade agreements;

The Constitution of 1978 as last amended by the 19th Amendment does not provide economy of Sri Lanka as a matter of concern for restriction on fundamental rights. It is only by the RIB that this new restriction is introduced. It has been argued during the hearing of the case that the above provision is unconstitutional as it is not caught up under Article 14A(2) of the Constitution that lays down restrictions on the right of access to information. Article 14A(2) provides that right of access to information can be restricted inter alia  “in the interest of ‘national security’”. What the Court has now done in the determination is to read (national)economy of Sri Lanka into the scope of national security.  

This constitutional interpretation of the Court is unprecedented in Sri Lanka. Never before had the apex court of the island held that fundamental rights of the persons of the country can be restricted on the grounds of prejudice to national economy. Moreover it is in this determination that the Court takes the opportunity to declare ‘serious prejudice to the economy of Sri Lanka’ as part and parcel of the interests of national security.

National Security is not defined anywhere in the constitution, not in the proposed bill. The Global Principles on National Security and the Right to Information, also called the Tshwane Principles, compiled in June 2013 as a project of Open Society Justice Initiative, does not define national security but recommends in Principle 2 that when national security is used to limit the right to information, it should have been ‘defined precisely in a country’s legal framework in a manner consistent with a democratic society’.  RIB does not do this and the Court has stepped in to this task, but not to define it, but to include national economy within its scope.

The third principle in Tshwane Principles provides that the fact that disclosure could cause harm to a country’s economy would be relevant in determining whether information should be withheld on the grounds of national economy, but not on the grounds of national security. Contrary to this principle the Court in holding the aforesaid interpretation has failed to appreciate the implications of reading national economy into national security and legitimizing the withholding of information on grounds of national security when such disclosure could be claimed to harm the country’s economy.  

In 1985 the United Nations Economic and Social Council adopted the Siracusa Principles on the Limitation and Derogation Provisions in the International Covenant on Civil and Political Rights. There are interpretative principles of ten limitation clauses provided therein in respect of restrictions on civil and political rights. National security is one such limitation clause and it does not identify national economy as a matter to be considered in its interpretation.

The determination of national economy as a national security concern has its historical and ideological roots. The shift of the judiciary to the far right has been a global phenomenon since the financial crisis in 2008. Many examples can be drawn from developed countries including United States, Britain and France. The judicial interpretation in the instant matter depicts the extent of facilitation the Court is prepared to offer for the economic and trade restructuring forced to be implemented by the Sirisena-Wickremasighe government.

Dipped deeply into the economic instability and faced with debt crisis, the Bill was brought in by the government to win over the democratic credentials and public trust that the ruling elite in the country had long been losing and to contain public discontent about the whole bourgeoisie establishment. The Great recession of 2008 that spread throughout the globe had direct implications to Sri Lanka and the economy was greatly affected, while massive spending on thirty year civil war against the Tamil toiling masses in the north and east had amassed a huge debt load. The loans granted and promised by the International Monetary Fund (IMF) dictated austerity measures and public welfare cuts and reduction of budget deficit. It also required overhaul privatization and foreign investment facilitation. These unpopular measures were inviting more and more public outcry, agitation and mass opposition. The World Bank and IMF demand that the governments around the world implement neoliberal policies in order to save capitalist market economy. The government of Sri Lanka is not spared.

In these circumstances, as can be observed in several other countries, the right of access to information regarding economic structuring programmes of the government must be strictly limited. The RIB seeks to limit this right of access to such economic sensitive information as provided in clause 5(1)(c) and it is the Court that legitimizes this restriction of prejudice to national economy by bringing it within the scope of national security, which is a restriction already laid down in the Constitution in Article 14A(2).  

The republic of Indonesia included the right to information in its constitutional amendment in 2000. It is provided in article 28F. In 2008 the Public Information Disclosure Act was brought in to regulate opening access to public information. Section 17 therein classifies the information that is limited on several exceptional grounds, including the obstruction of process of law enforcement,   defense and security of the state, information that could reveal national wealth of the country and that could harm diplomatic relations etc. National economic security is another ground of exception, but significantly is a separate grounds of limitation and not read within the purview of national security.

If the RIB is passed as law, the resulting effect would be the denial of access to information regarding decisions that are intended to ‘change’ economic and financial policies relating to salient economic features that are to affect the greater masses within the country. The information regarding all discussions, trade agreements, arrangements in respect of control and regulation of overseas exchange transactions, regulation of banking or credit, taxation, prices of goods and services, rates of wages and salaries will be non-accessible to the public. In denying access the public authorities are free to resort to exceptional clauses of prejudice claimed to be caused to the national economy and also to national security.

The determination has far reaching implications even if the RIB is not passed as law.  Once national economy is judicially identified as a concern of national security, it could most possibly imply that government is empowered to invoke national security measures at times of economic crises. The times of economic crises are the times of struggles of the working people. Thus, it would be legitimate before the future Court of law of this country even to declare a state emergency and call for essential services to suppress any working class agitation at times of economic turbulence and crisis in the interest of so called national security.
